Just because it does not state that it is protected by copyright does not mean that it is public domain. Generally, if something is posted without explicitly stating that it is public domain, we should assume that the owner still reserves the rights to it. In practice though, many owners do not care and so it is no big deal, but nonetheless they may reserve the rights to it.

The other issue is a cost/benefit issue. Much like speeding in a car, chances are that you can break the law and never get caught. This is why many people are willing to speed, and also the same reason that I just violated the copyright of the creator of whatiscopyright.org by reproducing his information here. It is sort of the idea that what they do not know will not hurt them, but there is always the risk that they may find out.
